Terms of Service

Heads up: Kings Health Plan is not insurance and is not a medical provider. Services are delivered by independent third-party clinicians and partner pharmacies. In an emergency, call 911.
1) Acceptance
These Terms of Service ("Terms") govern your access to and use of the Kings Health Plan website, member portal, and related offerings (collectively, the "Services"). By creating an account, purchasing a membership, or using the Services, you agree to these Terms and to our Privacy Policy.
2) Eligibility & Accounts
- You must be at least 18 years old to be a primary member.
- You agree to provide accurate information and to keep your account secure.
- We may suspend or terminate accounts that violate these Terms or applicable law.
3) Membership, Pricing & Billing
- Not insurance. Membership is a consumer health plan/benefit program and does not meet ACA minimum essential coverage.
- Recurring billing. Unless stated otherwise, memberships renew automatically each billing cycle (e.g., monthly) until canceled.
- Cancellation. You can cancel anytime through your dashboard or by contacting support. Cancellations take effect at the end of the current paid term unless we state otherwise. Partial-period refunds are generally not provided.
- Price changes. We may change plan features or prices with advance notice for future terms.
- Taxes/fees. You are responsible for applicable taxes and third-party charges not included in your membership.
4) Dependents
- Eligible dependents (e.g., spouse/partner/children) can be added per plan rules and limits.
- You are responsible for ensuring dependents meet eligibility criteria and for all charges associated with dependent use.
5) Telehealth & Pharmacy Partners
- Independent providers. Telehealth services are provided by independent, licensed clinicians and/or medical groups. Kings Health Plan is not a medical provider and does not practice medicine or dispense medications.
- Clinical judgment. Providers (not Kings Health Plan) determine medical appropriateness, including whether to diagnose, treat, or prescribe.
- Privacy & compliance. Our partners maintain their own compliance programs and privacy practices. See our Privacy Policy for how we handle your information.
- Emergencies. The Services are not for emergencies. Call 911 or go to the nearest emergency department.
6) Medications & Prescriptions
- No guarantee. Prescriptions are not guaranteed and may be unavailable or restricted by clinical guidelines, state laws, safety considerations, or supply constraints.
- Partner pharmacies. Dispensing and shipping are performed by partner pharmacies and are subject to their policies and availability.
- Formulary. Covered medications and pricing are subject to change. Certain meds or services may carry separate charges.
7) Acceptable Use
- Do not misuse the Services (e.g., fraud, harassment, unlawful conduct, unauthorized access, or interference with operations).
- Do not attempt to obtain controlled substances or restricted services in violation of law or clinical policy.
- We may investigate and take action (including suspension) for violations.
8) Referrals & Affiliate Program
- Referral tracking may use cookies or unique links. We may credit signups in our discretion if eligibility is met.
- If you join our affiliate program, additional terms will apply (see Affiliate Terms if applicable). We may modify or discontinue promotional programs at any time.
9) Intellectual Property
- The Services, including content, logos, and software, are owned by or licensed to Kings Health Plan and protected by law.
- You may not copy, modify, distribute, or reverse engineer the Services except as permitted by law.
10) Third-Party Services
The Services may link to or depend on third parties (e.g., telehealth platforms, pharmacies, labs, payment processors). We are not responsible for third-party content, policies, or actions. Your use of third-party services is subject to their terms.
11) Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation, or that clinical or pharmacy partners will approve any particular treatment or prescription.
12) Limitation of Liability
To the maximum extent permitted by law, Kings Health Plan and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; or for lost profits, data, goodwill, or business; arising out of or related to the Services or these Terms, even if advised of the possibility. Our aggregate liability to you for all claims will not exceed the amounts you paid to us for the Services in the twelve (12) months preceding the claim.
13) Indemnification
You agree to defend, indemnify, and hold harmless Kings Health Plan and its affiliates from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your breach of these Terms, or your violation of law or third-party rights.
14) Dispute Resolution
- Governing law. These Terms are governed by the laws of the State of [Your State], without regard to conflicts of law rules.
- Informal resolution. Before filing a claim, you agree to try to resolve the dispute informally by contacting us at support@kingshealthplan.com.
- Arbitration & waiver. Except for claims that can be brought in small-claims court, disputes will be resolved by binding arbitration on an individual basis. Class actions and jury trials are waived.
15) Changes, Suspension & Contact
- We may modify these Terms or the Services. If we make material changes, we'll provide notice (e.g., by updating the date above, email, or in-product notice). Continued use after changes means you accept the updated Terms.
- We may suspend or terminate access for violations, security risks, or unlawful use.
